These Terms & Conditions govern all services provided by Aspire Drafting Inc. (“Aspire,” “we,” or “us”) to its clients (“Client”).
By engaging our services, the Client agrees to the following:
1. Scope of Services
Aspire Drafting provides BIM coordination, MEP drafting, and related consulting services. All services are based on the information, drawings, and direction provided by the Client and/or project design team. Any services not specifically outlined in the agreed scope shall be considered additional work.
2. Additional Services / Change Orders
Construction projects evolve, and changes are expected. Any work requested, directed, or implied by the Client - whether verbally, via email, or through coordination meetings shall be considered authorized and billable. Formal written approval of a change order is not required for work to be considered valid and compensable.
3. Payment Terms
The Client agrees to pay for all services performed by Aspire Drafting, including additional work outside the original scope. Payment shall not be contingent upon: Owner approval, Third-party approval, Project funding status, Internal processing delays. All work performed at the request or direction of the Client shall be considered payable.
4. Client Responsibilities
The Client is responsible for: Providing accurate and complete project information, Coordinating with all design consultants and contractors, Reviewing and approving deliverables in a timely manner. Delays in providing information or approvals may impact project timelines and costs, affecting BIM coordination and overall project efficiency.
5. Coordination & Design Responsibility
Aspire Drafting provides coordination and drafting services only. We do not act as the Engineer of Record or Architect of Record and do not assume responsibility for: Design intent, Code compliance, Engineering calculations, Final installation or construction means and methods. Final responsibility for design compliance and installation lies with the project design team and contractor.
6. Use of Deliverables
All drawings, models, and documents produced by Aspire Drafting are intended solely for the specific project for which they were created. Use of these materials for other projects, purposes, or modifications without written consent is prohibited.
7. Limitation of Liability
Aspire Drafting shall not be liable for: Field installation errors, Contractor performance, Misuse or misinterpretation of drawings, Changes made by others after delivery. Our liability, if any, shall be limited to the value of the services provided.
8. Revisions & Project Changes
A reasonable number of revisions may be included as part of the original scope. Excessive revisions, redesign, or scope changes shall be treated as additional services and billed accordingly.
9. Refund Policy
Due to the nature of professional services, refunds are limited. Refunds, if any, are subject to review and apply only to work not yet performed or delivered. Work already completed, issued, or in progress is non-refundable.
10. Project Delays & Suspension
Aspire Drafting shall not be held responsible for project delays caused by: Incomplete or inaccurate information, Delayed client responses, Third-party coordination issues. If a project is paused or delayed for an extended period, additional fees may apply to resume work.
11. Termination
Either party may terminate services with written notice. The Client agrees to compensate Aspire Drafting for all work performed up to the date of termination.
12. Governing Law
These Terms & Conditions shall be governed by the laws of the State of New York.
